HotPause Health, Inc. Privacy Policy

1. Privacy Policy Overview

HotPause Health, Inc., together with its affiliates (collectively, “HotPause Health,” “us,” “our,” or “we”), owns, operates, and provides access to an interactive health and wellness e-commerce platform, including the website hotpausehealth.com and all related online interactive features and services (including but not limited to email communications, newsletters, chat features, our online store, review pages, sweepstakes, and contests) (collectively, the “Services” or “Site”). Our Services are intended for users located in the United States only.

Our online store features both HotPause Health branded products and curated menopause and perimenopause health and wellness products sourced from independent suppliers (“Suppliers”) through Shopify Collective and similar supplier-retailer arrangements (“Supplier-Fulfilled Products”). HotPause Health is the merchant of record for all sales, and your customer relationship is with HotPause Health regardless of which party fulfills the product. Our e-commerce platform is hosted on Shopify Inc. (“Shopify”), and your use of the Services is also subject to Shopify’s privacy practices as described below.

This Privacy Policy applies to all information collected about you when you interact with the Services, regardless of how it is collected or stored. It describes the types of information collected about or from you when you interact with the Services, how your information may be used, when your information may be disclosed, how you can control the use and disclosure of your information, and how your information is protected.

This Policy may be amended or updated from time to time. We encourage you to read this Privacy Policy carefully and to check this page regularly for updates. By interacting with our Services or providing us with your information, you agree to the collection, use, and sharing of your information as described in this Privacy Policy. If you do not agree with our policies and practices, please do not use our website or Services.

1.1 Shopify as Our E-Commerce Platform

Our online store is hosted on Shopify. Shopify provides us with the e-commerce platform that allows us to sell our products and services to you. Your transaction data is stored through Shopify’s data storage, databases, and the general Shopify application. Shopify processes your data on our behalf and is bound by its own privacy policy and data processing agreements. 1.2 Supplier-Fulfilled Products

Some products on our Site are sourced from independent Suppliers through Shopify Collective and fulfilled and shipped directly to you by those Suppliers. To facilitate the fulfillment and delivery of Supplier-Fulfilled Products, we share certain Personal Information (as defined below) with the relevant Supplier, including your name, shipping address, and order details. This information is shared solely for the purpose of fulfilling your order. Suppliers are bound by contractual obligations to protect your information and to use it only for order fulfillment purposes. Your customer service and privacy relationship remains with HotPause Health.

1.3 Children

The Services are not intended for use by children under 18 years of age or under the age of majority (“Minor(s)”). Minors should not provide any Personal Information or use our Services. Minors are not permitted to make purchases through the Services or obtain coupons or codes to purchase goods or services. If we discover that we have collected Personal Information from a Minor, we will delete that information immediately. If you believe a Minor has provided us with Personal Information, please contact us at hello@hotpausehealth.com.

2. Categories of Information We May Process

“Personal Information” means information that is about any individual, or from which any individual is directly or indirectly identifiable. “Process,” “Processing,” or “Processed” means anything done with any Personal Information, whether or not by automated means, including collection, recording, organization, structuring, storage, adaptation, alteration, retrieval, consultation, use, disclosure, dissemination, alignment, combination, restriction, erasure, or destruction.

We may Process the following categories of Personal Information about you:

2.1 Information You Provide Directly

  • Personal details: your name, username, login credentials, password, areas of interest, information provided in response to quizzes or surveys or to use health-related programs (such as perimenopause support programs), and photographs.

  • Demographic information: gender, age or date of birth, salutation, job title, and language preferences.

  • Contact details: postal address, telephone and/or mobile number, email address, and public social media handles or profiles.

  • Consent records: records of any consents you have given, including the date, time, means of consent, and related information.

  • Purchase history: records of purchases and prices, invoice records, payment records, billing address, payment method, cardholder or account holder name, payment amount, and payment date. Note: Payment card information is processed by our third-party payment processors (including Shopify Payments and other payment gateways) and is not collected or stored by us.

  • Views and opinions: any views and opinions you or other users choose to send to us, or publicly post about us on social media platforms or within the Services.

  • Health and wellness information: information you voluntarily provide related to your health, menopause stage, symptoms, wellness goals, and product preferences. This may constitute sensitive personal information under applicable law (see Section 2.3).

2.2 Information Collected Automatically

We and our service providers (including Shopify) automatically collect certain information when you use the Services:

  • Usage data and statistical information about how you interact with the Services, which may be aggregated.

  • Searches for and interactions with e-commerce opportunities, products, and product offerings.

  • Non-precise geolocation data (e.g., city or zip code level) derived from your IP address (“GeoIP Data”).

  • Device identification (“Device ID”), a distinctive number associated with your device.

  • Internet Protocol (“IP”) address.

  • Information collected through cookies, eTags, JavaScript, pixel tags, device ID tracking, anonymous identifiers, and other technologies regarding your visits to and interaction with the Services and marketing emails (“Online Data”).

  • Device type, settings, operating system, and software used.

  • Log files, which may include IP addresses, browser type, ISP, referring/exit pages, operating system, date/time stamps, and clickstream data.

  • Web beacons, pixel tags, clear GIFs, and similar tracking technologies.

  • Local Shared Objects and Local Storage, such as HTML5.

  • Mobile analytics data to understand the functionality of our applications.

2.3 Sensitive Personal Information / Health Data

Given the nature of our Services (menopause and perimenopause health and wellness), we may collect information that constitutes health data or another special category of sensitive personal information under applicable U.S. state law, including the California Consumer Privacy Act (CCPA), California Privacy Rights Act (CPRA), Washington’s My Health My Data Act, and other state health data privacy statutes. We will collect sensitive personal data only with your explicit consent, such as when you take actions leading to our obtaining it (e.g., completing a health quiz or creating an account). You may withdraw your consent at any time by unsubscribing from communications, by opting out of completing any health quiz, or by contacting us at hello@hotpausehealth.com. If you choose not to provide or allow us to collect some information, we may not be able to provide you with requested features, services, or information.

3. How We Collect Information

We may collect Personal Information about you from the following sources:

  • Data you provide: when you sign up for emails, newsletters, or SMS messages; register for an account; create a profile; enter a sweepstakes or contest; participate in surveys and quizzes; perform search queries; interact with the chatbot; contact us via email, telephone, or by any other means; or make a purchase.

  • Relationship data: in the ordinary course of our relationship with you (e.g., through purchase history).

  • Data you make public: information you choose to make public via social media or through product reviews published to our Services.

  • Service data: when you visit, download, use, or register to use any part of our Service.

  • Shopify platform data: information collected by Shopify in connection with your use of our store, including checkout data and analytics. Shopify acts as a data processor on our behalf and also collects data as described in its own privacy policy. We do not collect your credit card or other payment information.

  • Third-party content and advertising: if you interact with third-party content or advertising on the Services, we may receive Personal Information about you from such third-party

  • Third-party sources: We may collect or obtain your Personal Information from third parties who provide it to us. This may include offline channels such as through telephone or direct mail efforts; from customers, vendors, suppliers, third parties, commercially available or publicly available sources (e.g., data brokers, data aggregators, public databases, etc.); third-party affiliate network operators; referral sources; and social network sites or services (e.g., Facebook, X/Twitter, LinkedIn, etc.). If you use a third-party connection or log-in (e.g., Facebook or X/Twitter) to access the Services, create a membership or profile on any part of the Services, access our content, or forward our content to another person, platform, or service, we may also receive your username or email address for those third-party services or other information available about you or collected from you on those services

  • Supplier fulfillment data: information related to the fulfillment and delivery of Supplier-Fulfilled Products, such as shipping confirmation and tracking details provided to us by Suppliers.

Please note that HotPause Health is not responsible for information you voluntarily share in public areas of the Services, such as review sections. We discourage posting Personal Information in these areas.

4. Purposes for Processing Your Information

We may Process your Personal Information for the following purposes, subject to applicable law:

  • Provision of Services: providing and managing the Services, including account management, order processing, customer support, and store operations.

  • E-Commerce Operations: processing and fulfilling orders (including Supplier-Fulfilled Products), processing payments through Shopify Payments and other payment gateways, managing shipping and returns, and communicating order status.

  • Offering and Improving the Services: operating, managing, and personalizing the Services; identifying issues; planning improvements; and notifying you of changes.

  • Identity Verification: using information from third parties to verify your identity to provide the Services.

  • Surveys and Quizzes: engaging with you to obtain your views and learn about your interests.

  • Research and Analytics: analyzing user behavior, benchmarking, and conducting research based on your interactions with the Services.

  • Communications: communicating with you via email, telephone, text message, social media, post, or push notification regarding content, products, and information of interest, subject to your consent and applicable law.

  • Advertising and Marketing: providing interest-based advertising, developing promotional strategies, and marketing to current and prospective customers.

  • Fraud Prevention and Security: electronic security measures, monitoring of login records and access details, and implementing data security policies.

  • IT Administration: administration of information technology systems, network and device security, and compliance audits.

  • Financial Management: general business and financial management, accounting, and corporate audit.

  • Legal Compliance and Investigations: detecting, investigating, and preventing breaches of our Terms of Use, policies, and applicable law; and establishing, exercising, and defending legal rights.

  • For any other purpose with your consent.

We may also create Personal Information about you, such as records of your interactions with us and details of your purchase history, for internal administrative purposes and analysis. We may also use Personal Information you have provided to us with data obtained from third parties to enhance our records or enhance our ability to provide products and services, such as appending additional information to your profile.

5. Direct Marketing

We may Process your Personal Information to contact you via email, direct mail, SMS, or other methods to provide information regarding the Services and products that may interest you, in compliance with applicable law.

You may unsubscribe from our marketing communications at any time by following the unsubscribe instructions in our emails or by contacting us at hello@hotpausehealth.com. Please allow five to ten business days for changes to take effect. We may continue to send you transactional or service-related communications (such as order confirmations and shipping notifications) even if you opt out of marketing emails.

6. Cookies, Tracking Technologies, and Analytics

We and our service providers (including Shopify) deploy tracking technologies on the Services. These technologies enable us to assign unique identifiers, relate information about your use of the Services to other information about you (including your Personal Information), and analyze trends.

Technologies we use include:

  • Cookies (first-party and third-party) for analytics, administering and improving the Services, personalization, and advertising.

  • Pixel tags, web beacons, and clear GIFs to measure the effectiveness of advertising and track email engagement.

  • Local Shared Objects, Local Storage (HTML5), and eTags.

  • Mobile analytics software to understand the functionality of our mobile applications.

  • Shopify analytics and reporting tools.

You can control the use of cookies at the individual browser level. Various browsers offer their own management tools for removing local storage. However, disabling cookies may limit your use of certain features or functions on the Services.

6.1 Do Not Track / Global Privacy Control

Some browsers and devices offer “Do Not Track” (“DNT”) signals or Global Privacy Control (“GPC”) signals. Where required by applicable U.S. state law, we honor GPC signals as a valid opt-out of the sale or sharing of personal information for targeted advertising purposes.

7. Lawful Basis for Processing Personal Information

We may process your Personal Information based on one or more of the following legal grounds under applicable U.S. law:

  • Consent: where we have obtained your prior, express consent (used only for entirely voluntary Processing, such as collection of sensitive health data or marketing communications).

  • Contractual necessity: where Processing is necessary to fulfill an order, provide the Services, or perform a contract with you.

  • Compliance with applicable law: where Processing is required by federal or state law.

  • Legitimate business interests: where we have a legitimate interest in Processing for the purpose of managing, operating, or promoting our business, provided that interest is not overridden by your rights or interests.

8. Disclosure of Information to Third Parties

We do not sell Personal Information, nor do we share Personal Information for cross-context behavioral advertising purposes, and have not done so in the preceding twelve months.

We may disclose your Personal Information to the following categories of third parties:

8.1 Service Providers and Processors

  • Shopify: as our e-commerce platform provider, Shopify processes your data on our behalf and in accordance with its own privacy policy and data processing addendum.

  • Payment processors: including Shopify Payments and other payment gateways that process your payment information.

  • Analytics providers: including Google Analytics and Shopify analytics.

  • Email and marketing service providers.

  • Cloud hosting and data storage providers.

  • Customer support tools and platforms.

8.2 Suppliers (for Order Fulfillment)

When you purchase a Supplier-Fulfilled Product, we share the information necessary to fulfill and ship your order (such as your name, shipping address, and order details) with the relevant Supplier. This information is shared solely for order fulfillment purposes. Suppliers are contractually required to protect your information and to use it only for fulfilling your order. Suppliers do not receive your payment card information. Your customer service and privacy relationship remains with HotPause Health—all inquiries, returns, and data requests should be directed to us, not to Suppliers.

8.3 Legal and Regulatory Authorities

We may disclose your Personal Information to law enforcement agencies, courts, and regulatory authorities to respond to legal requests or orders, comply with applicable law, exercise or defend our legal rights, or to prevent or address emergencies, harm, threatened harm, violence, or abuse. We may also disclose your Personal Information to enforce or apply our Terms of Use or Terms of Sale and other agreements, including for billing and collection purposes.

8.4 Business Transfers

In the event that we sell, transfer, merge, or reorganize all or any relevant portion of our business or assets (including in the event of dissolution or liquidation), your Personal Information may be disclosed to the acquirer(s) or successor entity.

8.5 Professional Advisors

We may share Personal Information with outside professional advisors (such as accountants, auditors, or lawyers), subject to binding confidentiality obligations.

8.6 Contest and Sweepstakes Sponsors

If you enter a contest, competition, sweepstakes, or prize draw, your registration data may be shared with the sponsor and relevant third-party vendors. Please read the official rules carefully before submitting your information.

8.7 Third-Party Processor Obligations

When we engage a third-party processor (including Suppliers for order fulfillment), the Processor is subject to binding contractual obligations to: (i) process your Personal Information only in accordance with our written instructions; (ii) implement measures to protect the confidentiality and security of Personal Information; and (iii) comply with any additional requirements under applicable law.

The Services contain links to other sites or partners whose information practices may be different from ours. You should consult the privacy policies of these third parties to learn how your privacy is protected.

9. Data Security

We have implemented commercially reasonable technical and organizational security measures designed to protect your Personal Information against accidental or unlawful destruction, loss, alteration, unauthorized disclosure, unauthorized access, and other unlawful or unauthorized forms of Processing. Our platform benefits from Shopify’s enterprise-grade security infrastructure, including PCI-DSS Level 1 compliance for payment processing.

However, no method of transmission over the Internet or method of electronic storage is 100% secure. We cannot guarantee absolute security, and we are not responsible for any breach of security or for the actions of any third parties. The safety and security of your Personal Information also depends on you—please keep your password confidential and exercise caution when sharing information in public areas of the Services.

10. Data Retention

We retain your Personal Information only for as long as necessary to fulfill the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by applicable law. Criteria for determining retention periods include: the duration of our relationship with you, applicable legal obligations (such as tax and accounting requirements), and whether retention is advisable in light of our legal position (such as applicable statutes of limitations or regulatory investigations).

When Personal Information is no longer needed, we will securely delete or anonymize it in accordance with our data retention procedures.

11. Data Accuracy and Minimization

We take reasonable steps to ensure that your Personal Information that we Process is accurate, up to date, and limited to what is reasonably necessary for the purposes described in this Policy. If you inform us that any Personal Information we hold about you is inaccurate, we will take reasonable steps to correct or erase it.

12. Your Privacy Rights

Depending on your state of residence, you may have some or all of the following rights regarding your Personal Information. These rights are provided under applicable U.S. state privacy laws, which currently include the CCPA, CPRA, the Colorado Privacy Act (CPA), the Connecticut Data Privacy Act (CTDPA), the Virginia Consumer Data Protection Act (VCDPA), the Oregon Consumer Privacy Act (OCPA), the Utah Consumer Privacy Act (UCPA), the Texas Data Privacy and Security Act, the Indiana Consumer Data Protection Act, the Kentucky Consumer Data Protection Act, the Rhode Island Data Transparency and Privacy Protection Act, and other state privacy laws as they take effect.

  • Right to Know and Access: You have the right to know what Personal Information we collect, process, and share, and to request a copy of the Personal Information we hold about you.

  • Right to Delete: You may request that we delete the Personal Information we have collected about you, subject to certain legal exceptions. Exercising this right may result in loss of access to your account and associated purchases or features associated with your account.

  • Right to Correct: You may request correction of inaccurate Personal Information we hold about you.

  • Right to Opt Out of Sale/Sharing: You have the right to opt out of the sale of your Personal Information or the sharing of your Personal Information for cross-context behavioral advertising. We do not currently sell or share Personal Information for these purposes.

  • Right to Withdraw Consent: Where Processing is based on your consent, you may withdraw consent at any time.

  • Right to Object to Processing: You may object to our processing of your Personal Information for commercial purposes by emailing us. By objecting to Processing, you may not be able to access some or all of our Services.

  • Right to Limit Use of Sensitive Personal Information: You have the right to limit or object to our use of your sensitive Personal Information, including health data, race, religion, sexual orientation, gender identity, political opinions, or philosophical beliefs.

  • Right to Object to Automated Decision-Making: You have the right to object to decisions made solely through automated processing that produce legal or similarly significant effects.

  • Right to Data Portability: Where applicable, you may request that we provide you with a copy of your information on file with us. 

  • Right to Non-Discrimination: You will not be discriminated against for exercising your privacy rights.

  • Right to Authorized Agent (California): You may designate an authorized agent to make privacy requests on your behalf, subject to verification requirements.

  • Right to Appeal: In certain states, if we deny your privacy request, you have the right to appeal that decision. We will provide instructions on how to submit an appeal along with any denial.

The exact scope of these rights varies by state. There are also several exceptions where we may not have an obligation to fulfill your request. To exercise any of these rights, please email us at hello@hotpausehealth.com. You may be required to verify your identity before we can give effect to your request. We will respond to your request within the timeframe required by applicable law (generally 30 to 45 days, with extensions as permitted).

13. Controlling Your Information
